Individual entrepreneur Dubina Oksana Olegovna - an individual entrepreneur, registered in accordance with Russian law, operating, including through the Internet resource (online store) alenamodlen.ru.
Online store - a platform for the sale of goods on behalf of IP Dubina Oksana Olegovna, located on the site alenamodlen.ru.
Personal information - information, which the User provides about himself/herself in the process of using Services and / or at registration (creating an account), including, but not limited to, the User's personal information.
Personal Space - personalized interface of the Site with a set of user tools for using personalized Services on the Site.

Materials - objects of copyright, including but not limited to illustrations, drawings, photographic works and other works obtained by methods similar to photography, captured and reproduced on both traditional and electronic and other media, posted by User in his/her Instagram social network account.
Right to use the Materials - the right to perform the following actions: to make public, reproduce, publicly display, reprocess, distribute the Materials or any part thereof in any material form and by any means, including on the Internet, including, but not limited to the Site and official accounts of the brand ALENA MODLEN in social networks.
Right to use the Images - the right to perform the following actions: to disclose, reproduce, make known, publicly display, reprocess, distribute the Images or any part of them on any media in any material form and by any means, including, but not limited to the Site and official accounts of ALENA MODLEN brand in social networks.
3. Right to Use Materials/Pictures
All objects available on the Site, including design elements, text, graphics, illustrations, video, computer programs, databases, and other objects, as well as any content on the Site are the objects of exclusive rights of IE Dubina Oksana Olegovna, Users and other copyright holders, respectively.
Use of content, as well as any other elements of the Site is possible only within the functionality offered by the Site. No elements of the Site content as well as any content published on the Site can be used in any other way without prior permission of the right holder. Use includes, but is not limited to: reproduction, copying, processing, distribution on any basis, framing, etc. Exceptions are the cases expressly provided by the legislation of the Russian Federation.
The User's use of the elements of the Site content as well as any content for personal, non-commercial use is allowed provided that all copyright, neighbouring rights, trademarks and other notices of authorship are preserved, the name (or pseudonym) of the author/right holder remains unchanged, the corresponding object remains unchanged. Exceptions are the cases expressly provided by the legislation of the Russian Federation.
The User is forbidden to reproduce, distribute, reprocess for commercial or noncommercial purposes the elements of the Site, as well as the elements of the official accounts of the brand ALENA MODLEN in social networks, which are the objects of copyright in the absence of permission from the relevant rightholders to perform such actions.
From the moment of fulfillment of actions on the Acceptance by the User the User gives IP Dubina Oksana Olegovna the Right to use the Materials in the Internet in all countries of the world for the entire term of the exclusive right, and also expresses the full and unconditional consent to the use by IP Dubina Oksana Olegovna of the Images with the purpose of promulgation and further use by IP Dubina Oksana Olegovna of the Materials and Images on the Site, on the foreign sites, and also in the official accounts of ALENA MODLEN brand in social networks, with the purpose of The method of use of Materials and Pictures including, but not limited to: reproduction in any material form, bringing to the common knowledge, public display, processing, distribution on any media and in any way, including on the Internet, or use in any other way Materials and Pictures in full or in fragments, including, anonymous, i.e. without specifying the User, the Right holder, the represented citizen, pseudonym of the specified persons.
Oxana Olegovna Dubina has the right to independently decide whether to use or discontinue using the Materials/Picture, and is entitled to publish the Materials/Picture on the Site, on third party sites, and in official accounts of ALENA MODLEN brand in social networks at any time after the User Acceptance, and is also entitled at any time to stop using the Materials/Picture and delete them from the specified Internet resources. All risks associated with the publication of Materials/Images are borne by the User.
The User agrees that IP Dubina Oksana Olegovna has the right to place advertising banners and ads on the pages of the Site, third-party sites, as well as in the official accounts of the brand ALENA MODLEN in social networks, which contain Materials and Pictures received from the User.
The User has the right to revoke at any time the right to use the Materials and Pictures from IP Dubina Oksana Olegovna by sending a notice to the e-mail address info@alenamodlen.ru, or in writing to the location address IP Dubina Oksana Olegovna. Within seven (7) working days from the date of receipt of notice from the User, IE Dubina Oksana Olegovna undertakes to cease use of the Materials and Pictures by removing them from the Site and other Internet resources.
FE Dubina Oksana Olegovna has the right to remove previously posted Materials and Images at any time at her sole discretion and without giving any reasons, without prior notice.
User is solely responsible for the violation of any rights of third parties in the event of improper transfer of Materials and Images to FE Dubina Oksana Olegovna under this Agreement.
If a citizen's Image is obtained or used in violation of applicable laws of the Russian Federation, then that citizen, the User, the Material and Image Rights Holder shall be entitled to demand that the image be removed.
The User agrees that the Materials and Images are posted on the Site, on third-party sites, and in the official accounts of the brand ALENA MODLEN in social networks in the public domain for viewing by the general public with access to the relevant Internet resources.
You are responsible for unauthorized copying of the Materials and Images and for the unauthorized use of the Materials and Images published in accordance with the terms of this Agreement.
4. Warranties and Responsibilities of the User
By accepting the terms and conditions of this Agreement the User declares and guarantees that he is the author of the Materials / rightful owner of the Images and/or is duly authorized by the respective authors / rightholders to grant to FE Dubina Oksana Olegovna the right to use the Materials / Images, that he has all necessary permissions from the authors of the Materials and the persons depicted in the photographs to provide to FE Dubina Oksana Olegovna the right to use the Materials / Images, and that the User is not obliged to grant to FE Dubina Oksana Olehovna the right to use the Materials / Images.
The User guarantees that he is the proper copyright holder of the Materials and Images or has received permission from the copyright holder and the person depicted to disclose and use the image in the ways and on the terms specified in this Agreement, and in the event of death of the depicted, the copyright holder - the consent of his children, surviving spouse, and in their absence - with the consent of parents.
The Materials and Images transmitted by the User must not: violate the current legislation of the Russian Federation and the legally protected interests of third parties; promote religious, racial or ethnic hatred; be obscene or offensive, contain scenes of violence, advertisements for drugs, pornography and violate the rights of minors; violate copyrights and related rights of third parties; contain explicit commercial advertising of a trademark on goods which are not tobacco products.
The User is solely liable and considers IP Dubina Oksana Olegovna to be free from any compensation for damages/losses under claims of third parties made in relation to the Materials/Images and their contents. In the event of any third-party claims against IP Dubina Oksana Olegovna regarding the Materials/Images and their content, the User agrees to settle such claims and/or lawsuits on their own and at their own expense, or to indemnify IP Dubina Oksana Olegovna for the losses caused by such claims in full.
The User undertakes to reimburse property losses to FE Dubina Oksana Olegovna in accordance with Art. 406.1 of the Civil Code of the Russian Federation in the amount of sums aimed at compensating the losses incurred to third parties whose intellectual property rights were violated and/or the right provided by Art. 152. 1 of the Civil Code of the Russian Federation, as well as the User undertakes to reimburse court expenses, as well as the costs of preparing and conducting court cases, including the involvement of consultants (lawyers), including those occupying leading positions in their field of professional activity, as well as in the amount of amounts aimed at execution of court decisions, amounts aimed at payment of sanctions, penalties and fines under the relevant contracts.
The user has no right to transfer, sell, publish, move, reproduce, modify or alter the materials of the Site, as well as the official brand accounts ALENA MODLEN in social networks, or use them in any other similar way, both partially and in general, except for the written permission of IE Dubina Oksana Olegovna for these actions.
User is solely responsible to third parties for their actions related to the use of the Site, including if such actions will lead to a violation of the rights and legitimate interests of third parties, as well as for compliance with the law when using the Site.
Individual entrepreneur Dubina Oksana Olegovna has the right to take lawful measures to protect her intellectual rights in relation to the Site/Content in the official accounts of the brand ALENA MODLEN in social networks.
The validity of this Agreement in terms of warranty and liability of the User is indefinite.
5. Confirmation of the Agreement
Each Party guarantees to the other Party that it has the necessary legal capacity and capability, as well as all rights and powers necessary and sufficient for the conclusion and execution of the Agreement in accordance with its terms.
This Agreement comes into force upon User's acceptance of the terms of this Agreement.
Individual entrepreneur Dubina Oksana Olegovna takes commercially reasonable efforts to ensure the Site's functioning 24 hours a day, but does not guarantee the absence of breaks due to technical failures, preventive maintenance, as well as does not guarantee full or partial functionality of the Site.
In order to collect statistical data and User identification FE Dubina Oksana Olegovna has the right to establish and maintain information about IP-addresses of access Users.
6. Changing the Confidentiality Agreement
The Agreement may be amended by IP Dubina Oksana Olegovna without any special notice, the new version of the Agreement comes into force from the moment of its posting on the Internet, unless otherwise provided by the new version of the Agreement.
